You must also be able and competent to enter and agree with the terms, conditions and obligations set forth in this Agreement. By accepting this agreement, We can assume that You have the capacity to be bound by it. You may not use this website if you are under the legal age to do so. You will also need to be legally eligible, in your jurisdiction of residence, to access, join Sport X Tipster and/or affiliation links displayed on Website. Individuals are solely responsible to comply with their local, state and national laws and The Company shall not be held responsible nor liable if any Users are not complying with any of their local, state or national laws. If You cannot comply, please stop using the Website immediately.

For the avoidance of doubt Sport X Tipster DOES NOT facilitate betting on sports; it does not accept or place wagers; is not a sportsbook/bookmaker; is not a sports broker; does not facilitate nor does not intermediate betting; does not endorse Internet gambling, sports betting nor wagering of any kind. Sport X Tipster does not handle any payments for sports betting purposes, eventual winnings or losses.

Users must provide their full legal name, a valid email address, and any other information needed in order to complete the signup process and are responsible for keeping their password secure. Sport X Tipster.com cannot and will not be liable for any loss or damage from your failure to maintain the security of your account and password.

  5. Post SPAM Content, phishing content and/or links to dangerous websites;
  6. Contains software viruses or any kind, including but not limited to Trojan Horses, Worms, ransomware, adware, spyware, malware or any code of destructive nature;
  7. Impersonates any person or entity, including but not limited to Sport X Tipster.com or any of their owners, employees or in any other way that misrepresents your relationship with the Company;
  8. Is harmful to minors in any way, or provides them information from and/or access to the Website;
  9. To scrape the website manually or automatically, in order to collect or store personal data about other users and to contact them outside of the Website;
  10. Use manual or automated techniques to monitor, replicate or distribute any content or information provided on the Website;
  11. Intentionally or unintentionally violate any applicable local, state, national or international law;

You agree to indemnify and hold The Company, and its subsidiaries, affiliates, officers, agents, co-branders or other partners, and employees, harmless from any claim or demand, including reasonable attorney’s fees, made by any third party due to or arising out of your Content, your use of the Service, your connection to the Service, your violation of the TOS, or your violation of any rights of another. 

4. Abusive Behavior, Fraud and/or Resale of Service

Sport X Tipster’s mission is to create a safe environment for Users and to have access to fair and entertaining information.

We have a zero tolerance policy for fraudsters and predictions resellers!

Sport X Tipster uses state-of-the-art anti-fraud detection software to track down dishonest Members, fraudsters or any other Members that try to take advantage of the Service and/or other Members.

Members who are found to display such a behavior, can have their IP’s blocked, account suspended or terminated at any time. They will be permanently banned from joining our Website or Service again.    

It is strictly prohibited for Members to sell, resell, copy, duplicate, lease, post, transmit or distribute by any means Content and Services provided on this website to any 3rd party websites, entities and persons including but not limited to competitors, similar sports related websites, other tipster websites and/or other informational groups on various social networks.

The Content you will see on this website is for your informational purpose only and you’re not allowed to distribute it for either free or commercial purpose, without the express written approval of Sport X Tipster.

You are not allowed to share your account information with any other 3rd party. By doing so, your account will be indefinitely suspended and any account remaining balance will not be refunded.

Members are not allowed to share any personal information such as, but not limited to, name, address, email, website or phone number, through the features of the Website, including but not limited to, our private message service. Members are also prohibited to post any SPAM Content (and/or other promotional content/offers), phishing content and/or links to other websites on the Feed, on other Users page, in comments, private messages or anywhere on the Website.

We strongly encourage Users to report any Members that are breaching our TOS here. All reports received will be treated confidentially and User information will never be disclosed.

5. Intellectual Property

Sport X Tipster is the rightful owner of any data provided on the website. All rights refer to the design, logos, site structure, images, content, technology, data, software used in connection with the Service (“Software”) and other aspects that contain proprietary and confidential information that is protected by applicable intellectual laws and other laws. It is strictly forbidden to modify, rent, lease all right, loan distribute or create derivative works based on the Service or the Software, in whole or in part, unless an express written authorization is issued by The Company.

6. Modification/ Cancellation OR Termination of Service

Sport X Tipster.com reserves the right to modify, discontinue (temporary or permanently), the Service (or any part tehereof) with or without notice and to terminate this Agreement at any time. The decision will be made at the sole discretion of The Company and can be made without any cost, charge or liability.

You agree that The Company shall not be held responsible to you or to any third party for any modification, suspension or termination of Service or Portion of the Site at any time.

7. Disclaimer of Warranties

By agreeing to these TOS you expressly understand, accept and agree that:

  1. Your use of the service is at your sole risk;
  2. The service provided is on an “as is” and “as available” basis; Sport X Tipster makes no warranty that:
    • The Service will meet your requirements;
    • The Service will be uninterrupted, timely or error-free;
    • The results obtained from the use of The Service will be accurate or reliable;
    • Any errors found on The Website, in the code, software, typo errors but not limited to, will be corrected;
    • The quality of the Service, products, Content, information, or any other material purchased or provided to You through the use of the Platform will meet your expectations;
  3. Sport X Tipster cannot be held responsible for any material downloaded or obtained through the use of The Service. The complete responsibility belongs the User for any misuse of the Service. Users should acknowledge the risks associated with the use of any website and should take all security measures in order to stay safe online;
  4. No warranties will be created by information (oral or written), obtained by our Members from Sport X Tipster or the Service unless expressly stated in this TOS.

8. Limitation of Liability

Sport X Tipster shall not be held responsible or liable to any Member of the Sport X Tipster.com Website for any direct or indirect damages arising from the use of the Website.

The Company relies on third party Content provider for, but not limited to, events, markets, results and odds. The Company cannot be held responsible for the accuracy or timeliness of any third party supplied information. Further, The Company cannot be held liable for any loss or damages you may incur, for any content provided by third party websites when visiting or leaving our Website via a link provided by Us or any other Members. It’s the sole responsibility of the User to check the accuracy of the information provided and verify it, before using it or acting upon it. The User is also responsible for its own online safety and to do its own due diligence before engaging in any activities on the Website and when leaving the Website.

Sport X Tipster.com shall not be held liable for any Website errors, maintenance, unforeseen circumstances, downtime or server issues that can affect the normal usage of the Website. Sport X Tipster.com shall not be held liable if any notifications or new Content is missed by User.

Members expressly understand and agree that shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses (even if the company has been advised of the possibility of such damages), resulting from:

(i) the use or the inability to use the service;

(ii) the cost of procurement of substitute goods and services resulting from any goods, data, information or services purchased or obtained or messages received or transactions entered into through or from the service;

(iii) unauthorized access to or alteration of your transmissions or data;

(iv) statements or conduct of any third party on the service;

(v) any other matter relating to the service.

You certify to Sport X Tipster that You agree to these TOS, including but not limited to legal fees, awards of damages, losses or costs that We may incur as a result of any claim made directly or indirectly based on the violation of these TOS.

9. Refund Policy

The Company provides Members refunds with 7-day money back guarantee on any products/services purchased on our Platform. If Members are, for any reason, not entirely happy with their purchase, we will issue a full refund, no questions asked.

To request a refund, please contact us here with your purchase details within seven (7) days of your purchase. To be eligible for refund, Members need to provide their registered username, email address and order number (sent on the registered email after ordering) and optionally few words, about why you’re requesting your refund.

Refunds are being processed within 21 business days period.

The refund can only be made for the Weekly plan. If you bought a Monthly plan or a Yearly plan, sorry, but you’re not entitled to refund by any means.

11. Termination of Account

You agree that Sport X Tipster, in its sole discretion, may terminate your account, access to Website our use of the Service, for any reason, including, but not limited to The Company’s belief that you have violated or acted against the spirit of the TOS. The Company may, in its sole discretion, immediately deactivate and/or delete your Sport X Tipster member profile, without prior notice, in case The Company finds that you have breached any terms stipulated in the TOS.

In any case, you agree that The Company shall not be held liable to you or any third-party for any termination of your access to the Service.

12. Account Security

You agree and understand that you are responsible for maintaining the confidentiality of your login credentials for your Sport X Tipster.com account. You agree that any information provided in your account to be true, current and completely accurate. Should any information change, you agree to update your account accordingly. You understand that you must not disclose your login credentials to any third party. Your right to access our Website is given to you personally, and is not transferable by you to any other entity. By breaching this agreement you will be held liable and your account can become suspended or terminated.

If you become aware of any unauthorized access to your Account or Profile Information, you must contact Sport X Tipster immediately here.

13. Miscellaneous

The TOS constitutes the legal agreement between you and Sport X Tipster.com and governs Your use of the Website and Service. You may also be subject to additional terms and conditions that may apply when you use affiliate or other third party content providers.  The TOS and the relationship between you and The Company shall be governed by the laws of the Republic of Romania without regard to its conflict of law provisions. You and The Company agree to submit to the personal and exclusive jurisdiction of the courts located in the Republic of Romania.

The courts of Republic of Romania shall have exclusive jurisdiction over any dispute that may arise in connection with the performance of these TOS. The same applies to any issues with the Website usage and/or The Company’s Services.

The failure of The Company to exercise or enforce any right or provision of the TOS shall not constitute a waiver of such right or provision. If any provision of the TOS is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties’ intentions as reflected in the provision, and the other provisions of the TOS remain in full force and effect. You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of the Service or the TOS must be filed within one (1) year after such claim or cause of action arose or be forever barred.

14. Advertising and Promotions

The Company runs advertisements and promotions on Sport X Tipster Website. They are part of our Platform and by creating a Sport X Tipster.com account you agree that The Company has the right to display such advertisements and promotions. Members agree that they will not attempt to block, interfere, hijack or modify via JavaScript or by any other means the advertised content. Doing so is subject to immediate termination of Service and permanent account termination. Advertisements and promotions are subject to change without any further notice. Your correspondence or business dealings with, or participation in promotions of, advertisers found on or through the Service, including payment and delivery of related goods or services, and any other terms, conditions, warranties or representations associated with such dealings, are solely between you and such advertiser. You agree that The Company shall not be responsible or liable for any loss or damage of any sort incurred as the result of any such dealings or as the result of the presence of such advertisers on the Service.
